Ms. Roy, learned advocate for the State is also present. Records reveal that as there was a delay in preferring the present appeal, the application being CRAN 1 of 2026 has been filed for condonation of delay. Drawing the attention of this Court to the averments made in the application for condonation of delay, Mr. Gupta, learned advocate appearing for the appellant submits that there was no deliberate delay on the part of the appellant in preferring the present appeal. 2 Mr. Mukherjee learned advocate appearing for the accused opposes the appellant’s prayer for condonation of delay. Ms. Roy learned advocate appearing for the State has left the issue to the discretion of this Court. Upon hearing the learned advocates appearing for the respective parties and considering the materials on record, we are satisfied with the explanation given towards delay in preferring the appeal. Accordingly such delay is condoned and the application for condonation of delay being CRAN 1 of 2026 is disposed of. In re: CRA(DB) 222 of 2026 Appeal is admitted. Call for the records. Issue usual notices. Paper books be prepared within a period of 4 weeks from the date of receipt of the Trial Court Records.
