This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division) 1st Court at Alipore, South 24 Parganas to dispose of Title Suit No. 294 of 2015 expeditiously. Learned advocate appearing for the petitioners submits that on an application under Order 18 Rule 17 of the Civil Procedure Code filed by the plaintiff, PW-1 was recalled and September 30, 2026 has been fixed for cross-examination of PW-1 on recall. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge forthwith.
2 In the light of the submission made by the learned advocate appearing for the petitioners this civil revision application stands disposed of by requesting the learned Civil Judge (Jr. Division) 1st Court at Alipore, South 24 Parganas to dispose of Title Suit No. 194 of 2015 as expeditiously as possible, preferably within a period of nine months from the next date fixed, without granting any unnecessary adjournment to either of the parties.
