Government Pleader for Revenue 3 BSB,J W.P.No.15202 of 2026 The Court made the following Order: This writ petition was filed under Article 226 of the Constitution of India to issue a writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in illegally levelling, closing and obstructing the pond / vagu situated in Survey Nos. 10 and 76 of Salapuvanipalem Village, under Thadi Revenue Limits, Paravada Mandal, Anakapalli District, and constructing a side road / walking pathway over the said water body for the benefit of a newly developed venture, despite the revenue records in MeeBhoomi / Adangal classifying the said land as Gedda (Vagu), as illegal, arbitrary, unconstitutional, violative of Articles 14 and 21 of the Constitution of India, contrary to environmental laws and the directions issued by this Court in W.P. (PIL) No. 140 of 2022, dated 14-09-2022, and consequently direct the respondents to remove the encroachments / obstructions, restore the pond / vagu to its original condition, protect the free flow of rainwater, and pass such other order, which this Court deems fit in the interest of justice. 02. When the writ petition was heard on 18.06.2026, learned Assistant Government Pleader for Revenue placed on record a copy of written instructions of the respondent No.4 in Rc. No. 187 / 2026 / SA Dt.18.06.2026, wherein it was recorded that Ac. 3.40 cents in Survey No. 10 and 3.94 cents in Survey No. 76, Thadi village and Paravada Mandal was classified as Cheruvu (tank) and that upon receiving information that the G.V.M.C., Zonal Office, Ankapalli / respondent No. 5 was taking activity of jungle clearance and land levelling in the above said land, the V.R.O., Thadi and the field staff were instructed to visit the site and accordingly, they visited the site and thereafter no other work was done. As the subject land is the Government land of water body, the same was recorded at the request 4 BSB,J W.P.No.15202 of 2026 of the learned counsel for the petitioner. The hearing was adjourned to this date i.e., 22.06.2026, for filing written instructions regarding jungle clearance said to be done at the request of the local residents near the subject land. But, further written instructions have not been given. 03. The learned counsel for the petitioner requested to close the writ petition recording the written instructions, dated 18.06.2026 wherein it was stated that no further action was taken up. 04. As such, the writ petition is disposed of recording the submissions made in the written instructions noted above. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ ___ JUSTICE B.S.
