The petitioner appearing in person seeks a direction upon the Officer in charge, Liluah Police Station to submit an explanation with regard to non compliance of the injunction/status quo orders passed in Title Suit no. 91 of
2004. Learned counsels for the private respondents submit that the petitioner ought to approach the learned trial Court who has granted the order of injunction for appropriate orders. The petitioner alleges that the orders of injunction/ status quo granted by the learned trial Court are not implemented by the police authority. Several applications submitted by the petitioner before the learned trial Court for implementation of the said orders have not yielded any fruitful result. Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the petitioner alleges that the injunction/status quo orders of the learned trial Court are not being implemented by the police authority, the petitioner is at liberty to approach the learned trial Court who has passed the said orders.
2 The learned trial Court is directed to take necessary steps for implementation of the orders passed by him/her. In the event such application is filed by the petitioner, learned trial Court shall deal with the same upon granting reasonable opportunity of hearing to all concerned. No fruitful purpose shall be served by keeping the writ petition pending. The same is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
