Matter is taken up for consideration in presence of learned advocates representing petitioner and State respondents. 2. Petitioner being the President of Haldia Refinery Sramik O Karmachari Vishwakarma Puja Utsab Committee, 2026 (hereinafter referred to as “said Committee”), has approached this Court with the present writ petition seeking permission from concerned police authority which would enable the said Committee to hold Vishwakarma Puja on 18th September, 2026 and 19th September, 2026. 3. Learned advocate representing petitioner has drawn attention of this Court to memo dated 24th August, 2026 issued by Assistant Manager (Admn.) for Senior Deputy Manager (Admn.) of Haldia Dock Complex, Syama Prasad Mookerjee Port, Kolkata whereby permission was accorded to the said Committee to hold Vishwakarma Puja on the land of Syama Prasad Mookerjee Port, Kolkata (for short, “SMPK”) on 18th September, 2026 and 19th September, 2026 subject to fulfillment of certain conditions as delineated therein. 4. It is further submitted on behalf of petitioner that in order to comply with one of the conditions as [2] stipulated in said memo dated 24th August, 2026, Director General, West Bengal Fire & Emergency Services was approached for clearance in prescribed pro-forma but it is contended that unless “No Objection” certificate from concerned police authority is obtained, necessary clearance/ permission will not be issued by concerned authority of West Bengal Fire & Emergency Services. Petitioner prays for direction upon the concerned police authority to provide “No Objection” certificate. 5. Mr. Sankar Prasad Dalapati, learned Additional Government Pleader representing State respondents has opposed this writ petition on the score that other conditions delineated in memo dated 24th August, 2026 issued by Assistant Manager (Admn.), SMPK are required to be fulfilled including obtaining permission from CISF. It is further contended that since other conditions as delineated in memo dated 24th August, 2026 are not complied with, permission is not accorded by concerned police authority to hold Vishwakarma Puja. 6. Having considered the respective submissions made on behalf of parties, it appears that Vishwakarma Puja will be organized on the land of SMPK subject to fulfillment of conditions delineated in memo dated 24th August, 2026 issued by Assistant Manager (Admn.). In terms of Clause (d) of said memo dated 24th August, 2026, petitioner for organizing Vishwakarma Puja is required to obtain necessary permission/ statutory clearance from West Bengal Police Authority and West Bengal Fire & Emergency Services, Haldia. Pursuant to said memo dated 24th August, 2026 petitioner approached concerned authority of West Bengal Fire & Emergency Services for obtaining clearance but on perusal of prescribed pro-forma, which is at page 23 of the writ petition, it appears that in order to obtain permission/ clearance from West Bengal Fire & Emergency Services, petitioner is required to obtain “No Objection” certificate from respective police station. 8. However, according to petitioner, concerned authority of Haldia Police Station is not granting permission to hold Vishwakarma Puja on 18th September, 2026 and 19th September, 2026. 9. From the case made out in the writ petition, it appears that Vishwakarma Puja is not going to be organized on public land rather it is to be organized on the land of SMPK subject to fulfillment of conditions as stipulated in memo dated 24th August, 2026 issued by Assistant Manager (Admn.), SMPK. If concerned police authority does not provide permission to petitioner, in that event, petitioner will not be able to obtain clearance from concerned authority of West Bengal Fire & Emergency Services for organizing puja on 18th September, 2026 and 19th September, 2026. 10. From the submissions made on behalf of State respondents, it is not demonstrated that granting permission to petitioner to organize Vishwakarma Puja on 18th September, 2026 and 19th September, 2026 would pose difficulty so far general public is concerned since puja is going to be organized on the land of SMPK. In aforesaid conspectus Inspector-in-Charge, Haldia Police Station being respondent no.4 is directed to issue “No Objection” certificate to petitioner by tomorrow, 16th September, 2026 which will enable petitioner to obtain necessary clearance/ permission from concerned authority of West Bengal Fire & Emergency Services for organizing Vishwakarma Puja on 18th September, 2026 and 19th September, 2026. 12. However, it is made clear that said Committee has to organize puja strictly following conditions as stipulated in memo dated 24th August, 2026 issued by Assistant Manager (Admn.) of SMPK. 13. With the aforesaid directions writ petition stands disposed of. 14. Learned advocates representing petitioner and State respondents are directed to communicate gist of this order immediately to concerned police authority without waiting for server copy of the order. 15.
