ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused on bail in Crime No.136 of 2025 of Yerragondapalem Police Station, Prakasam District, registered against the Petitioner/Accused herein for the offences punishable under Section 194 of ‘the BNSS’. 2. Mr. Tharigopula Surya Chaitanya, learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence. He has been falsely implicated in this case. He submits that the Petitioner has not committed any offence. He is a law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail. Therefore, it is prayed that the present petition be allowed. 3. Per contra, Mr. P. Somayaji, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioner. It is submitted that the investigation is not yet completed and that some more witnesses are yet to be examined. Hence, it is urged that the petition be dismissed. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. On perusal of the record, the Petitioner is the sole accused in this case. The allegation against him is that he murdered his wife by strangulating her

with her own saree, looping it around her neck and pulling it tight, which resulted in her instant death due to suffocation. It is further alleged that on earlier occasions also, the Petitioner used to harass his wife for various reasons and inflicted severe injuries upon her. After thorough investigation, a charge sheet has been filed, and the accusation appears to be well-founded.
The Petitioner was arrested on 07.04.2026. He has been in judicial custody for the past 83 days. Initially, the case was registered as one of death due to unknown causes. However, in the course of investigation, the FIR was altered to a case of murder. 6. Considering the nature of the allegations, the gravity of the offence, and the impending sentence of imprisonment against the Petitioner, this Court is not inclined to enlarge the Petitioner/Accused on bail at this juncture. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
