1. Affidavits of service filed in Court today are taken on record. 2. The petitioner participated for appointment in 1st SLST (AT) Upper Primary Level-2016 in the subject Arabic. The petitioner was recommended for appointment in a school and he is already serving in the subject school. His appointment, however, is yet to be approved. 3. He relies upon documents issued by EIILM University, Sikkim wherefrom he claims to have pursued Bachelor of Arts (Arabic) in the session July 09 –July 12. Provisional certificate was issued by the said University in his favour on 22nd September, 2013. 4. Prayer has been made to direct the respondents to approve his appointment. 5. Learned advocate for the school submits, upon instruction that, on perusal of the documents relied upon by the petitioner, the school

sought for an advice from the State respondents as to whether the petitioner can be approved in the school. 6. Learned advocate for the school relies upon the information provided by the University Grants Commission to the petitioner under the Right to Information Act, 2005 on 3rd June, 2025 wherein it has been clearly mentioned that Director, (Higher Education), Human Resource Development Department, Government of Sikkim may validate the Degrees of 2009-10 under three disciplines i.e. B.A. (Hospitality and Tourism), BCA and MBA for students admitted within the territorial jurisdiction of the State of Sikkim based on the admission records available with the University of Sikkim campus/State Government. Degrees in other disciplines except in the three subjects as specified above and beyond academic year 2009-10 shall not be valid. 7. It has been submitted that as the petitioner was unable to produce the final certificate of graduation, the graduation qualification of the petitioner cannot be relied upon. 8. It has also been submitted that the petitioner passed the Higher Secondary Examination with the subject Sanskrit. The petitioner did not have the combination of Arabic in his subjects.
All of a sudden, the petitioner cannot be permitted to take Arabic as a subject in the graduation level. 9. Upon hearing the submissions made on behalf of both the parties and on perusal of the documents placed before the Court, it appears that, a doubt has been raised with regard to the graduation degree relied upon by the petitioner. 10. The issue of approval of the petitioner was forwarded by the Additional District Inspector of Schools, Secondary Education, Bongaon Sub-Division to the Chairman, West Bengal Central

School Service Commission to find out a way to solve the problem to accord approval of the petitioner as Assistant Teacher. 11. As the issue appears to be pending before the Chairman, West Bengal Central School Service Commission, the instant writ petition is disposed of by directing the Chairman, West Bengal Central School Service Commission to take a decision with regard to the approval of appointment of the petitioner strictly in accordance with law. The educational certificates relied upon by the petitioner shall be thoroughly verified prior to taking a decision in the matter. 12. Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of communication of this order. 13. A reasoned order shall be passed and communicated to all the necessary parties. 14. If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by all the respondents without any further delay. 15. The writ petition stands disposed of. 16. Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court. 17. Certified server copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
