Bhattacharjee, Mr. Krishnendu Pal … for the Petitioner. Mr. Niladri Saha … for the State. 1. Affidavit-of-service, filed by the petitioner in Court today, is taken on record. 2. The petitioner is a shop owner. He alleged that some persons had encroached upon the P.W.D. land in front of his shop room. In order to ventilate his grievance, the petitioner made a representation dated July 18, 2022 to the Executive Engineer, P.W.D. Hooghly Division. Thereafter, the Chief Engineer, Head Quarters, P.W.D. by a memo dated July 21, 2022 requested the Executive Engineer, Hooghly Division, P.W.D. to take immediate action in that regard. 3. Heard Mr. Bhattacharjee, learned advocate appearing for the petitioner. 4. The learned advocate for the State is present. He handed over two communications, one being a memo dated September 16, 2022, issued by the Assistant Engineer, P.W.D., Hooghly Sub-Division-I, addressed to the Block Land and Land Reforms 2 Officer, Dhaniakhali Block. By the said memo, the BL&LRO was requested to demarcate the land of Chinsurah – Dhaniakhali road between 23 and 24 kms. in order to identify the encroachers in front of the land bearing Mouza – Kagnan, Khatian No. 514, L.R. Dag No.156, J.L. No.37, P.S. – Dadpur, District – Hooghly. The Block Land and Land Reforms Officer, Dhaniakhali Block was further requested to provide a sketch map showing the encroachment for taking further course of action in this regard. By another memo, the same request was also made on September 29, 2022 by the Assistant Engineer, P.W.D., Hooghly Sub-Division-I to the Block Land and Land Reforms Officer, Polba-Dadpur Block. 5. The learned advocate appearing for the State respondents submits that in spite of issuance of the memo dated September 16, 2022 and September 29, 2022, no effective steps in this regard have been taken. 6. In view of the above, I direct the respondent no. 4 to take necessary steps and to pass a reasoned order after extending an opportunity of hearing to the petitioner and all interested parties. The respondent no. 4 is further directed to complete the entire exercise within a period of six weeks from the date of communication of this order and shall take all consequential steps in connection with his decision, in accordance with law. 7. Accordingly, the writ petition stands disposed of. 3 8. However, there shall be no order as to costs. 9. Parties are directed to act on the basis of the server copy of this order.
