Accused in Crime No.272/2026 registered by Malur Police Station, Kolar, for the offences punishable under Sections 109, 115(2), 351(2), 352 and 118(1) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.272/2026 was registered by Malur Police Station, Kolar, for the aforesaid offences against the petitioner herein based on the first information dated 26.06.2026 received from Lakshmamma, wife of injured victim - Subramani. In the said case, petitioner was arrested on 20.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.712/2026 was rejected on 05.08.2026. In the first information that was submitted on 26.06.2026 by the wife of the injured victim, it is stated that on 24.06.2026, her husband Subramani and petitioner herein had fought near bar and restaurant and petitioner allegedly had assaulted and pushed him to the ground. Madhusudhan, who is the son of the first informant had thereafter brought his injured father to their house from the place where he was lying down on the ground before the bar and restaurant and on 25.06.2026, since Subramani had lost his consciousness, he was immediately shifted to a Hospital and thereafter, on 26.06.2026 his wife had approached the police. During the course of investigation, petitioner herein was arrested on 20.07.2026. 5. A reading of his remand application would go to show that on the alleged date of incident, petitioner had questioned Subramani, who had consumed alcohol, as to why he had misbehaved with his wife. Therefore, there was a quarrel between petitioner and Subramani and petitioner allegedly assaulted Subramani with his hands and pushed him to the ground. As a result, he fell down and his head allegedly came in - 4 - HC-KAR CNR: KAHC010565002026 NC: 2026:KHC:51020 CRL.P No. 12444 of 2026 contact with hard surface and he suffered injuries. Subramani, who was admitted in Hospital has now been discharged and his wound certificate would go to show that his condition is stable. Out of 3 injuries suffered by him, two have been certified as grievous injuries by the Hospital in which he was admitted. Petitioner, aged 23 years has no other criminal antecedents. Major portion of investigation is already completed. Petitioner has not used any weapon to assault the injured victim. Under the circumstances, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.272/2026 registered by Malur Police Station, Kolar, for the offences punishable under Sections 109, 115(2), 351(2), 352 and 118(1) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the - 5 - HC-KAR CNR: KAHC010565002026 NC: 2026:KHC:51020 CRL.P No. 12444 of 2026 Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
