GP FOR AGRICULTURE 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 10667 of 2026 ORDER:- This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “....to issue a Writ, Order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the in action of the Respondent Nos.2 to 5 in not transferring the sanctioned subsidy amount even though the approved tractors have been delivered to the eligible farmers in 2019 itself as being illegal, arbitrary and unconstitutional and in violation of fundamental right under Art. 14, 19 and 21 of the Constitution of India and consequently direct the respondents to deposit the sanctioned subsidy amount of Rs.11,40,000/- along with interest at 12 percent forthwith to the petitioner without any further delay…” 2. Heard Sri Phani Diraj, learned counsel representing Sri Sudhakara Rao Ambati, learned counsel for the petitioner and Ms. M. Sandhya Deepthi, learned Assistant Government Pleader for Agriculture for the respondents. 3. Learned counsel for the petitioner would submit that the grievance of the petitioner in this writ petition is that the respondent Nos.2 to 5 are not transferring the sanctioned subsidy amount of Rs.11,40,000/-, even though the approved tractors have been delivered to the eligible farmers in 2019 itself, till date. 4. Learned Assistant Government Pleader for Agriculture, relying upon the written instructions dated 22.06.2026, would submit that the office of the 4th respondent has verified the available records and found that the total eligible subsidy payable to the petitioner towards the supply of agricultural implements under the SMAM Scheme is Rs.11,40,000/-. It is further submitted that the 4 Department of Agriculture has requested the Finance Department to release the lapsed budget and that the Finance Department is releasing the same in a phased manner. Upon receipt of the requisite budget, the Department of Agriculture will take necessary steps, in accordance with the prescribed procedure, for release of the subsidy amount. She, on behalf of the respondents, seeks three (3) months' time to obtain the necessary budget allocation from the Finance Department and to release the admitted subsidy amount to the petitioner. 5. In the light of the above submissions, the Writ Petition is disposed of, granting the respondents a period of three (3) months, as prayed for, to release the subsidy amount. However, the respondents are directed to pay the due amount of Rs.11,40,000/- to the petitioner, together with interest at the rate of 9% per annum from the date of filing of the present Writ Petition. The petitioner is also at liberty to work out their remedies before the appropriate forum, in accordance with law, with regard to their claim for interest for the period from the date on which the amount became due, till the date of filing of the present Writ Petition, according to law and subject to limitation. There shall be no order as to costs.
