Mr. Sattwik Bhattacharyya Mr. Aashutosh Bhattacharyya ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiff and is directed against a judgment and decree dated August 4, 2026 passed by the learned Civil Judge (Sr. Div.) at Ranaghat, Nadia in Title Suit No.168 of 2023. An appeal lies under Section 96 of the Code of Civil Procedure against a judgment and decree passed by the learned trial judge in a suit. For such reason this Court is not inclined to entertain this application under Article 227 of the Constitution of India. CO 3090 of 2026 stands dismissed as not entertained. It is however made clear that this order shall not preclude the petitioners from approaching the appropriate forum in accordance with law. The learned advocate on record of the petitioners shall be permitted to take back the certified copy of the judgment and decree passed in the title suit by replacing the same with a photostat copy thereof. There will be no order as to costs. 2 All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
