14.09.2026 Court No.35. D/L. 23. Kausik (Rejected) CRM (M) 1915 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Thakurpukur Police Station Case No. 78 of 2024 dated 19.03.2024 under Sections 366A/370/370A/372/373/120B of the Indian Penal Code, 1860 read with Section 4 and Section 17 of the POCSO Act, 2012 and Sections 3, 4, 5, 6 and 7 of the Immoral Traffic (Prevention) Act, 1956. And In the matter of : Jayanta Roy ……Petitioner. Mr. Manojit Debnath Mr. Akash Sarkar ….for the Petitioner. Ms. Jhuma Sen Mr. Samsul Laskar Ms. Arpita De …for the Victim Girl. Mr. Somnath Adhikary Mr. Arijit Banik ….for the State. Learned advocate appearing for the petitioner submits that petitioner was arrested on 27.03.2024 and since then he is in custody. Although the prosecution has relied upon 25 witnesses, till date not a single witness has been examined. Learned advocate for the private opposite party is present and opposes the prayer for bail. 2 State has produced the case diary, drawn the attention of the Court to the statement of the victim. On a consideration of the same, I find there is active participation of the present petitioner for trafficking. Considering the same, I am of the opinion this is not a fit case for bail. As such prayer for bail of the petitioner in CRM (M) 1915 of 2026 is dismissed. Learned Trial Court would ensure that some witnesses are examined at the earliest. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
