It is Submitted that, the above Writ petition is filed under Article 226 & 227 of Constitution of India read with Section 482 of Code of Criminal Procedure Seeking for Quashing the Complaint filed by the Respondent and FIR registered by the Rajarajeshwari Nagar Police in Crime.No.0116/2023 dated on 07/04/2023 against the Petitioner for offence punishable under Section 177,192 of Indian Motor Vehicle Act and under Section 3 of the Karnataka Open Place Disfigurement Act 1951 & 1981, before the Hon'ble 2nd Addl. ACMM Court, Nrupatunga Road, Bengaluru City. 2. It is Submitted that, the respondent police filed the Final Report in the above said crime before the Hon'ble 2nd Addl. ACMM Court, Nrupatunga Road, - 3 - HC-KAR CNR: KAHC010199182023 NC: 2026:KHC:50278 WP No. 8941 of 2023 Bengaluru City. Hence this petition becomes infructuous. WHEREFORE, this Hon'ble Court may kindly permit the petitioners to withdraw the above writ petition with liberty to file a fresh Petition for change of circumstances, in the interest of justice and equity.” Placing the memo on record, petition is dismissed as withdrawn.
