In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Beldanga P.S case no. 652 of 2025 dated 13/9/25 under sections 115(2)/303(2)/318(4)/329(4) of the BNS. In the matter of: Shamim Akhtar ...Petitioner. Mr. Md. Golam Nure Imrohi Mr. Partha Pratim Sinha …for the petitioner. Mr. Sanjoy bardhan Ms. Pritha Paul …for the State.
1. Learned counsel appearing for the petitioner submits as follows. The petitioner is the son-in-law of the de-facto complainant. There was a delay of 25 days in lodging the FIR. It is alleged that the petitioner had fraudulently got a property of the victim registered in his name. He also took money, which he did not return.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on a statement of a neighbour, according to which the petitioner had also taken money from the aged de-facto complainant for giving her a job in the Railways. However, the case diary does not contain any document in this regard. It does not even contain the papers regarding the transfer of the property.
3. Considering the above and the other materials available in the case diary, although I am inclined to grant
