ORAL ORDER
Heard the learned counsel appearing for the petitioner and learned High Court Government Pleader for respondent No.1-State.
2. This petition is filed to quash the charge sheet in the Special Case No.816/2026 pending before LXX Additional Sessions Judge (CCH-71) Bengaluru.

Learned counsel appearing for the petitioner would submit that the proceeding is arising from the FIR in Crime No. 364/2025 for the offences alleged under Sections 103(1), 238 of Bharatiya Nyaya Sanhita, 2023 and Section 3(2)(v) of Digitally Signed by ANANT RAMNATH HEGDE

Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.
4. It is submitted that the petitioner is not named in the complaint. The complaint is filed alleging that the petitioner's sister was found dead in the place where she was residing. The Police after investigation have filed a charge sheet only on the basis of call detail records and would submit that the Police suspect that the petitioner had an affair with the deceased.

Learned counsel for the petitioner would submit that charge sheet materials do not point to any illegal act or crime committed by the petitioner and would submit that the trial is only a futile exercise and the proceeding has to be quashed.
6. It is further submitted that there are no forensic expert's opinion in the charge sheet, as such, the proceedings has to be quashed.
7. Learned High Court Government Pleader would submit that Police after investigation have submitted the Digitally Signed by ANANT RAMNATH HEGDE

charge sheet. The call detail records would indicate a close relationship between the petitioner and the deceased. The
contentions raised by the petitioner is to be considered after the trial.
8. The Court has considered the contentions raised at the Bar and perused the records.
9. The charge sheet is filed based on the call detail record. The Police apparently have collected the materials which indicate close relationship between the petitioner and the deceased. It is the contention that the petitioner even on the date of death of the victim, had made a phone call to the victim.
10. Under these circumstances, the matter requires trial.
11. Accordingly, the Criminal Petition is dismissed.
12. Observations made in this order is only confined to the merit of the petition. The Court has not expressed any Digitally Signed by ANANT RAMNATH HEGDE
