Petitioner participated in a selection for appointment as Assistant Teacher, Government Primary School in District Pauri Garhwal. According to him, he scored 76.67 quality point marks in the selection, which entitles him for appointment against a post in Science (OBC) category, however, petitioner was denied appointment, and a candidate with lower quality point marks has been offered appointment. 5. Learned State Counsel was asked to get instructions. Mr. S.C. Chaudhary, learned State Counsel submits that appointment was not offered to the petitioner, as he was relying upon two Permanent Resident Certificates, one issued from Uttarakhand and another issued from State of U.P., therefore, an inquiry has been ordered and till conclusion of the inquiry, one post has been kept reserved, as per the instructions received by him from the office of District Education Officer concerned. Learned counsel for the petitioner submits that the writ petition may be disposed of in terms of the statement made by learned State Counsel. 7. The writ petition is, accordingly, disposed of in terms of statement made by learned State Counsel, however, in the ongoing inquiry, petitioner shall also be given opportunity of hearing. Till conclusion of inquiry, one post of Assistant Teacher shall be kept vacant.
