GP FOR FINANCE PLANNING The Court made the following: 3 SRK, J WP.No.7392 of 2026 O R D E R This Writ Petition is filed seeking the following relief: “….to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents in not releasing the amount of Rs.3,87,065/-, even after finalizing the bills, payable to the petitioner in relation to the works i.e., Construction of CC drain from Kummari Neelambaram (H) to Gudipudi Bhaskara Rao (H) in Burripalem Village in Tenali Mandal, vide Agreement No. 44/2023-24, dated 09.11.2023 is questioned, as the same is illegal, arbitrary and consequently direct the respondents to pay for payment of amount of Rs.3,87,065/- with interest @ 24% per annum for the delayed amount to the petitioner in respect of execution of above-mentioned work forthwith and pass such other order.” 2. Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Panchayat Raj and Rural Development and the learned Standing Counsel for Gram Panchayat. 3. The petitioner claims to be Chairman of Works Committee, Burripalem Village, engaged in the execution of civil works, and that she was entrusted with various works of the Panchayat Raj Department and the Roads & Buildings Department on tender basis. It is the case of the petitioner that she was awarded a contract for execution of the work viz. Construction of CC drain from Kummari Neelambaram (H) to Gudipudi Bhaskara Rao (H) in Burripalem Village in Tenali Mandal vide agreement No.44/2023-24, dated 09.11.2023. It is the case of the petitioner that she deposited the requisite security amount and executed the work to the satisfaction of the authorities concerned, and upon completion of the work, Respondent authorities measured the same and recorded the measurements in the Measurement Books. 4. It is the grievance of the petitioner that notwithstanding the completion of the work and its measurement by the competent authorities, the amount due towards the executed work has not been paid till date. According to the petitioner, although the work was completed several months ago, the 4 SRK, J WP.No.7392 of 2026 respondent authorities have not released the admitted amount payable to her. Aggrieved by the non-payment of the said amount, the petitioner filed the present Writ Petition. 5. Learned Assistant Government Pleader for Gram Panchayat and Rural Development, on written instructions, from the Executive Engineer, RWS & S Division, Guntur-4th respondent, submits that there is no dispute with regard to the execution of the work by the petitioner. According to her, the petitioner is entitled to an amount of Rs.4,13,364/- after statutory deductions such as Income Tax, GST, Labour Cess, etc., aggregating to Rs.53,035/-, and that proposals for release of grant were submitted to the authorities concerned, and she sought two months’ time for payment of the said amount. The written instructions are placed on record. 6. Having regard to the fact that there is no dispute with regard to the works executed by the petitioner and the amount payable to her, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.4,13,364/- to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
