Mr. Kunal Ganguly Mr. Subhodip Maity …for the petitioner Mr. Narayan Debnath ..for the State Learned advocate for the petitioner submits that the petitioner has been falsely implicated in the instant case of legal statement of co- accused. According to the State, the petitioner was plying on the motorcycle which was carrying the offending materials. Materials in the case diary suggest that the petitioner fled away from the spot. Having considered that the case is at the stage of investigation and there is evidence which suggest that the petitioner was in the motorcycle, I am of the view that this is not a fit case for granting anticipatory bail. The application for anticipatory bail, being CRM (A) 2661 of 2026, is, thus, dismissed.
