JUSTICE V SRISHANANDA ORAL ORDER Heard both sides. These two revision petitions are filed by wife and husband respectively, challenging the order of grant of interim maintenance in a sum of Rs.25,000/- under the provisions of Protection of Women from Domestic Violence Act. 2. Grant of sum of Rs.25,000/- as interim maintenance was subject matter of appeal filed by the parties in Criminal Appeal Nos.297/2024, 472/2024 and 1866/2024. Learned Judge in the First Appellate Court, after hearing the parties, noted that the Order is interim in nature and subject to final result, dismissed all the appeals. 3. Being aggrieved by the same, it is the wife and husband who have filed the present revision petitions respectively. 4. Since the order that has been passed by the learned jurisdictional Magistrate by exercising the powers vested under the provisions of Protection of Women from Domestic Violence - 4 - HC-KAR NC: 2026:KHC:22117 CRL.RP No. 332 of 2026 C/W CRL.RP No. 111 of 2026 Act, parties are at liberty to adduce oral evidence and also place documentary evidence on record if the assets and liabilities filed by the respective parties are incorrect and, then seek appropriate orders at the hands of the jurisdictional Magistrate in the pending proceedings. 5. Since the order is interim in nature, expressing any opinion on the merits of the matter in the present revision petitions is totally unwarranted, as the same may prejudice the case of the parties during the trial one way or the other. 6. Taking note of the relevant factors and also that criminal cases are pending against the husband and his family members for the offence under Section 498A of the Indian Penal Code and other allied offences, it is desirable that parties shall place necessary oral and documentary evidence on record for proper adjudication of the pending proceedings before the jurisdictional Magistrate. 7. It is also to be noted that this Court while considering the prayer of husband, has reduced the quantum from Rs.25,000/- - 5 - HC-KAR NC: 2026:KHC:22117 CRL.RP No. 332 of 2026 C/W CRL.RP No. 111 of 2026 to Rs.15,000/- as interim measure taking note of the relevant aspects. 8. Accordingly, the following: ORDER i. Criminal Revision Petitions are dismissed. ii. The quantum of maintenance as reduced by this Court shall hold for the pending proceedings, till final order is passed. iii. If there is any arrears as is complained by the wife, necessary recourse in law be taken by the wife. iv. Amount in deposit is ordered to be withdrawn by the wife under due identification. v. Further taking note of the fact that the matter is pending from the year 2023, learned Trial Magistrate is directed to dispose of the same in a time bound manner, not later than 30th September 2026. vi. It is made clear that this Court has not expressed any opinion on the merits of the matter. viii. Both the parties are directed to file their income proof before the Trial Court positively on the next date of hearing before the Trial Magistrate.
