Respondents 1/6 https://www.mhc.tn.gov.in/judis WP(MD)No.16823 of 2026 PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 2 and 3 to conduct survey and demarcate the boundaries in respect to petitioner's properties in S.No.187/2, 187/4 and 187/5 measuring extent of about 54 ares, 40.50 ares and 31 ares respectively situated at Kadamalaigundu Village, Andipatti Taluk, Theni District and consequently direct the 4th respondent police to grant adequate police protection at the time of conducting survey and for laying boundary stone by considering petitioner's online application dated 24.03.2026 and representation dated 07.04.2026 within a time frame fixed by this Court. The petitioner is claiming right over the property in S.No.187/2, 187/4 & 187/5 measuring to an extent of about 54 ares, 40.50 ares & 31 ares respectively situated at Kadamalaigundu Village, Andipatti Taluk, Theni District. The said property is the petitioner's husband's ancestral 2/6 https://www.mhc.tn.gov.in/judis WP(MD)No.16823 of 2026 property. The petitioner claims right over the said property by way of settlement deed in Document No.394/2010 dated 03.03.2010. When the adjacent land owner disturbed the petitioner's boundaries and possession, the petitioner had preferred O.S.No.117/2022 on the file of the District Munsif Court, Andipatty, for injunction. The said suit was allowed on 09.09.2025 granting injunction against the private respondents. In such circumstances, the petitioner is seeking to survey the property. 3. Therefore, the 2nd respondent/Tahsildar is directed to survey the property after issuing notice to the petitioner as well as the respondents 5 to 8. In case, the Tahsildar is seeking police protection, the 4th respondent shall provide the same. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order. 4. This Court is directing the 2nd respondent to adhere to the following Standard Operating Procedures: a. The 2nd respondent shall issue notice to the petitioner immediately reaching the spot where survey is to be 3/6 https://www.mhc.tn.gov.in/judis WP(MD)No.16823 of 2026 conducted. The petitioner shall affix the signature by receiving the notice of survey. b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. 5.
