D/L – 22 14/09/2026 Court No.42 S.Kundu CRR 2116 of 2023 Avijit Das @ Hulo Vs. State of West Bengal 1. Despite earlier direction to the parties vide order dated August 12, 2026 to take steps for representation; none appears to represent the petitioner and the opposite party today. 2. It appears from the revisional application that the petitioner, by way of the present revisional application, sought for quashing of the proceeding being NGR(EX) No. 154 of 2022 under Section 110 of the Code of Criminal Procedure pending before the Court of Special Executive Magistrate, Chandannagar, Chandannagar Division. 3. I have perused the impugned order dated 16th January, 2023, wherefrom it appears that the petitioner was directed to appear before the Court of learned Executive Magistrate on 30th January, 2023 and submit show- cause as to why he shall not be bound down for good behaviour bond under Section 110 of the Code of Criminal Procedure along with security. 4. The legal force of the impugned order dated 16.01.2023 passed under Section 110 of the Cr.P.C., by its very nature, has abated due to influx of time, as such the revisional application has now become infructuous. 2 5. In view of the above discussion, CRR 2116 of 2023 be dismissed as infructuous. 6. There shall be not order as to costs. 7. Interim order, if any, stands vacated. 8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities. (Uday Kumar, J.)
