Learned counsel appearing for the petitioners submits that the petitioners have purchased small extents of land in Survey No.1085/3-1, 1054, 1051 from the original DKT Patta allotties, thereafter, the petitioners have been in continuous possession and enjoyment of the property and the petitioners have also constructed dwelling units and residing there. It is submitted that the property taxes are also collected by the respondent Municipality.
It is further submitted that while things stood thus, the respondent Municipality has issued notices by determining that the petitioners have encroached on the irrigation canal land and that the notices are issued in pursuance of W.P (PIL) No.234 of 2012. It is submitted that the orders passed in the W.P (PIL) referred above, have nothing to do with the possession of the petitioners as they have been in possession of the property ever since they purchased the same.
Learned Standing Counsel appearing for the Respondent Corporation submits that the survey numbers in the notices issued to the petitioners are different with that of the survey

ORDER OFFICE NOTE numbers as mentioned in the title deeds of the petitioners. It is also submitted that the notices have been issued to evict the encroachers on the irrigation canal bank area in pursuance of the directions of the learned Division Bench of this Court.
Considering the submissions and after perusing the orders passed in W.P (PIL) No.234 of 2012, the Principal Secretary to the Government, Municipal Administration Department was called upon to take appropriate action with regard to land occupied by Kavali Municipality and rising construction of shops there and the steps that are required to be taken against the said Act.
Learned Assistant Government Pleader appearing for the Revenue Department requests time to ascertain the status of the DKT Pattas, which was originally issued in favour of the vendors of the petitioners.
Post on 21.07.2026 for filing of the counters.
In the meanwhile, there shall be a direction to the respondents to maintain status quo in all respects. ______ HN, J SR
