The petitioner has filed this writ petition praying for, inter alia, a writ of or in the nature of Mandamus commanding the concerned respondents to consider the petitioner’s complaint dated October 16, 2025, and forthwith cause an inspection or raid at the manufacturing premises of private respondent located at 3, Dharmahata
2 First Lane, 3 No. Kolkata – 700006 and at 44A, A. Road/Jheel Road, Liluah, Howrah-711106, and to take immediate steps of seizure/custody of all raw materials, machinery, packaging material, finished goods, dispatch records and other relevant documents found at such premises. 7. From a perusal of the said complaint dated October 16, 2025, it will be evident that the petitioner’s grievance is that the private respondents are engaged in manufacturing of inferior quality of Besan from Chana Dal by mixing various products like Suji, Maida, Broad Beans, Rice Powder, Cornflakes and other ingredients with artificial incense/aroma for flavour and pack it to sell the same in the open market at Burrabazar. 8. It is further alleged in such complaint that the aforesaid private respondents use Chana Dal of inferior quality for making Besan and then they mix banned cereal-grass pea and artificial incense/aroma for flavouring and other contents etc. which is injurious to the health of common people at large. 9. Learned advocate representing the petitioner submits that this is not a Public Interest Litigation, but he is a consumer of food products
3 from the local market. Hence, he is filing the present writ petition. 10. Learned advocate representing the respondent nos. 8 to 10/State has handed over two communications received from the Officer-in- Charge, Jorabagan Police Station and the Inspector of Police and I/C Liluah Police Station.
Copies of such communication are taken on record. The same have also been handed over to the learned advocate representing the petitioner. 11. It appears from the communication dated September 6, 2026, issued by the Officer-in- Charge of Jorabagan Police Station to the learned advocate representing the respondent nos. 8 to10/State that the officials of the Food and Edible Oil Section of Enforcement Branch, Kolkata Police visited the private respondents godown situated at 3/Dharmahata 1st lane, Kolkata- 700006 and collected and seized a sample of Besan from there for further course of action. As per the available records of Jorabagan Police Station, it has been found that the officials of Food and Edible Oil Section of Enforcement Branch, Kolkata Police have lodged a case against the private respondent nos.13, 14 and 15 vide Jorabagan Police Station Case No. 38 dated March 25, 2026 under Sections 272/274/61(2)/318(4) of
4 the Bharatiya Nyaya Sanhita, 2023 and investigation of the case has been taken up by them. 12. Learned advocate for the respondent nos. 8 to 10 accordingly submits that there has been no inaction on the part of the police authorities in so far as the Jorabagan Police Station is concerned. 13. From the communication dated September 7, 2026, issued by the Inspector of Police and I/C Liluah PS, it appears that enquiries were conducted by such police station on the representation received by it from the petitioner. Pursuant to such enquiries, the said police station has ascertained that the private respondent company is a duly registered private limited company and possesses a valid FSSAI licence and relevant trade related documents.
It is further stated in such communication that during the inspection of the premises at 44, A. Road, P.S. Liluah, Howrah, no banned, prohibited or prima facie substandard substances, including Suji, Maida, Rice Powder, corn derivatives, broad beans or khesari dal, as specifically alleged in the representation made by the petitioner, was found in the said premises. Reference may be drawn to Liluah Police Station GDE No.-872 dated November 14, 2025 in respect of the foregoing. 5
14. Learned advocate representing the respondent no.2 states that he has no instructions in the matter. 15. In reply, the learned advocate for the petitioner states that since action has been taken by the above mentioned two police stations, the petitioner has no further grievance. 16. Accordingly, this writ petition being WPA 25799 of 2025 is disposed of with the above observations. 17. There will be no order as to costs. 18. Since no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents. 19. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 20.
