1. Affidavit-of-service filed on behalf of petitioner is taken on record.
2. Learned advocate representing petitioner expresses dissatisfaction with regard to investigation being carried out in Dum Dum GRPS Case No.18/26 dated 9th July, 2026. Prayer is made for directing investigating agency to take certain steps and expedite investigation and thereby furnishing report before the designated court.
3. Learned advocate representing State respondents has filed a communication dated 1st September, 2026 of Deputy Superintendent of Police (GEDE), Sealdah GRP District and same is taken on record. Copies of
communication dated 1st September, 2026 are made over to learned advocates representing petitioner and respondent no.7.
4. It is disclosed in communication dated 1st September, 2026 that one Deputy Superintendent of Railway Police being lady officer was entrusted with responsibility to investigate aforesaid criminal prosecution and investigating officer is not holding post below the rank prescribed under Rule 7 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Rules, 1995. It is also stated in communication dated 1st September, 2026 that in order to maintain confidentiality steps taken by investigating officer are not being shared with defacto- complainant.
5. However, according to investigating officer CCTV footage was inspected and preserved, statements of witnesses were recorded under Section 180 BNSS
2023. It is also disclosed that accused was interrogated on 6th August, 2026 and he duly cooperated with investigation.
6. In view of disclosure of aforesaid steps taken by investigating officer who was appointed in terms of statutory provisions, at this stage no further order need be passed on this writ petition except a direction upon investigating officer to expedite investigation and submit report before designated court.
