The writ petitioner is a resident of Adarsha Pally, opposite to Sarathi Battery Shop, Post Office – Gouranga Nagar, Police Station – New Town, Kolkata – 700 162, which fall within the local limits of the Ward No.21 of the Bidhannagar Municipal Corporation (in short BMC). 3. The petitioner has noticed that the private respondent no.6 has recently initiated a construction work of G+1 storied building at House No.n0004, Gali no.12, Block – A, Jyotinagar, Post Office – Gouranga Nagar, Police Station – New Town, Kolkata – 700 162 within the local limits of the Ward No.21 of the BMC by deliberately violating the Rules as framed in the West Bengal Municipal Corporation Act, 2006 read with West Bengal Building Municipal Rules, 2007. 4. Having got no other alternative, the petitioner has been constrained to submit a representation appearing at page 20 to the writ petition, before the municipal authority on 19th September, 2025 praying for immediate demolition of unauthorised and illegal construction carried out by the private respondent no.6 at Gali no.12, Block – A, House no.nooo4, Jyotinagar, Ward no.12. But the said representation has not been considered by the municipal authority till date. 5. Even after service, private respondent no.6 is not represented. 6. The learned advocate appearing on behalf of the BMC submits that the writ petition can be disposed of by directing the respondent no.4 to consideration the representation dated 19th September, 2025 in accordance with law. 7. Considering the submissions of the respective parties, I am of the opinion that the purpose will be served if the representation dated 19th September, 2025, being the annexure – ‘P/2’ to the writ petition (page – 20) be considered by the respondent no.4 in accordance with law. 8. In view of the above, the respondent no.4 is directed to consider the representation dated 19th September, 2025 within a period of 12 weeks from the date of communication of this order after giving an 2 opportunity to all the affected parties and to pass a reasoned order within two weeks thereafter. 9. However, I make it clear that I have not gone into the merits of the case. 10. As the affidavits have not been called for, allegations levelled against the respondents are deemed to have been denied. 11. In view of the above, the present writ petition, being WPA 7514 of 2026 is disposed of. 12. There shall, however, be no order as to costs. 13. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities. (Atarup Banerjee, J.) 3
