Kausik (Allowed) CRM (M) 1939 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chakdah Police Station Case No. 121 of 2026 dated 28th January, 2026 under Sections 64(1)/353(2)/351(3)/3(5) of the BNS, 2023 read with Sections 4/12/15 of the POCSO Act, 2012. And In the matter of : Rahul Sahaji ……Petitioner. Mr. Shibaji Kumar Das Mr. Dipendu Sarkar ……for the Petitioner. Dr. Pradim Banerjee, APP Ms. Shalu Gupta ….for the State. Learned advocate appearing for the petitioner submits that the other two accused persons namely Sushanta Bar @ Santu and Totan Dutta @ Laden have been granted bail by the learned Special Court. State opposes the prayer for bail but is unable to refute the contention that other two accused persons named above are on bail. I have taken into account the statement of the victim under Section 183 of the BNSS and I am of the opinion that the present petitioner is similarly if not better situated than the other accused persons who have been granted bail. 2 Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Rahul Sahaji shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional Sessions Judge, Kalyani, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Trial Court. With the aforesaid observations CRM (M) 1939 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
