Panguluru Mandal in Prakasam District with Estimate cost Rs. 11.20 Lakhs as illegal, arbitrary, unreasonable and against the Articles 14 and 21 of the Constitution of India, 1949 and consequently direct the respondents to pay the bill amount of Rs. 4,32,188/- Rupees Four Lakhs Thirty Two Thousand One Hundred and Eighty Eight Only, for the work executed by the petitioner and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased 3 pleased to direct the respondents to consider the representation of the petitioner, dated 16/03/2026, and to release the withholding bill amount payable to the petitioner to a tune of Rs. 4,32,188/- Kupees Four Lakhs Thirty-Two Thousand One Hundred and Eighty- Eight Only, pending disposal of the writ petition and pass Counsel for the Petitioner: 1. GP FOR FINANCE PLANNING The Court made the following: ORDER:- This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer: “…to issue a Writ or Order or direction, more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the respondents in non-payment of bills payable to the petitioner to a tune of Rs. 4,32,188/- [Rupees Four Lakhs Thirty-Two Thousand One Hundred and Eighty Eight Only] for the work done pertaining to Construction of Anganwadi Center Building at Kondamuru (V) and (G.P.) of J. Panguluru Mandal in Prakasam District with Estimate cost Rs. 11.20 Lakhs as illegal, arbitrary, unreasonable and against the Articles 14 and 21 of the Constitution of India, 1949 and consequently direct the respondents to pay the bill amount of Rs. 4,32,188/- [Rupees Four Lakhs Thirty Two Thousand One Hundred and Eighty Eight Only], for the work executed by the petitioner and to pass…” 4 2. Case of the petitioner, in brief, is that he is engaged in executing civil works in R&B Department, Panchayat Raj Department and other Government Departments, more particularly, in the execution of laying of roads and sewage works, etc. It is stated that the respondents entrusted to him the work of ‘Construction of Anganwadi Center Building at Kondamuru (V) & (G.P.) of J.Panguluru Mandal in Prakasam District’, with an estimated cost of Rs.11.20 lakhs and an agreement was entered into vide Agreement No. /2018-19 dated 17.09.2018. The petitioner completed the work and initially first part of bill amounting to Rs.4,47,550/- was paid out of the total value of Rs.8,79,738/. The balance amount of Rs.4,32,188/- is stated to be pending for payment. However, despite submission of representation dated 16.03.2026, the respondents have failed to release the balance amount till date. Aggrieved thereby, the present Writ Petition has been filed by the petitioner herein. 3. Heard. Perused the record. 4. Learned Assistant Government Pleader for Panchayat Raj & Rural Development, on written instructions, submits that the petitioner executed the construction work and that the value of the work executed by the petitioner is Rs.8,62,472/-. She further submits that an amount of Rs.4,83,380/- has already been paid to the petitioner and the balance amount payable to the petitioner is Rs.3,79,092/- only, whereas the petitioner has claimed Rs.4,32,188/-. It is further submitted that as and when the funds are released from Government, the respondents will arrange payment to the petitioner. 5 She, therefore, seeks three months’ time to make payment of the said amount. The written instructions are placed on record. 5. Having regard to the fact that there is no dispute with regard to the execution of work undertaken by the petitioner and in view of the submissions made by the learned Assistant Government Pleader for Panchayat Raj & Rural Development, the respondent authorities are directed to pay the admitted amount of Rs.3,79,092/- (Rupees Three Lakhs Seventy-Nine Thousand and Ninety-Two only) to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
