14.09.2026 Court No.35. M/L. 101. Kausik (Rejected) CRM (A) 920 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ratua Police Station Case No. 54 of 2026 dated 15.01.2026 under Sections 85/115(2)/117(2)/64(2)f/175(2)/110/79/351(2)/3(5) of the BNS, 2023. And In the matter of : XXX ……Petitioner. Mr. Md. Wasim Akram Mr. Anwar Hossain ……for the Petitioner. Mr. Pritam Roy Mr. Rajesh Kr. Shah ….for the State. Learned advocate appearing for the petitioner submits that petitioner is a school teacher staying 70 Kms. away from the address mentioned by the defacto complainant and as there was a matrimonial dispute, petitioner being the elder brother- in-law has been falsely implicated in the instant case. Learned advocate for the State has drawn the attention of the Court to the statement under Section 164 Cr.P.C. of the victim. 2 Having considered that there is a specific accusation against the present petitioner, I am of the view that this is not a fit case for anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioner in CRM (A) 920 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
