JUSTICE RAJESH RAI K ORAL ORDER After arguing for some time, the learned counsel for the petitioner submitted that respondent No.2-Deputy Registrar of Companies issued a notice to the petitioner's company on 21.02.2022, calling upon it to furnish all the financial records on or before 10.03.2022. He further submitted that the Ministry of Corporate Affairs had issued a notification dated 14.02.2022 extending the time for furnishing the annual returns up to 15.03.2022. Despite the same, respondent No.2, even before the expiry of the extended period, initiated the complaint against the petitioner on 02.03.2022. 2. It is further contended that the company is still in operation and has filed all its annual returns till date. In such circumstances, it is contended that the ingredients of the offences alleged against the petitioner are not made out. 3. However, considering that the proceedings are still at the initial stage, in my considered view, it would be appropriate to reserve liberty to the petitioner to place before the - 4 - HC-KAR CNR: KAHC010646502024 NC: 2026:KHC:50134 CRL.P No. 12126 of 2024 Investigating Officer all the documents relied upon in the present petition, along with additional documents, if any, as may be available, within a period of two weeks from the date of receipt of a copy of this order. Upon such production, the Investigating Officer shall consider the said documents in accordance with law and proceed to file the final report, without causing any undue delay.
