…...... 03/ 24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 3(5), 299 and 303(2) of B.N.S. and under Section 3, 11(1) (a)(b)(d)(e)(h)(i)(j) of the Prevention of Cruelty to Animal Act, under Sections 3, 4 and 12 of Jharkhand Bovine Animal Prohibition of Slaughter Act & Rule 47(a)(b), 48, 49(a)(b), 51(a), 52, 53 and 54(1)(2) of the Transport of Animals Rules.
2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order.
3. Learned A.P.P. opposes the prayer for bail.
4. Petitioners are the driver and cleaner of the vehicle, which was transporting bovine animal and the same was beyond the loading capacity of the vehicle. Petitioners are in the custody since 08.12.2025.
5. Considering the period of custody and the nature of allegation and the fact that these petitioners are only the driver and cleaner of the vehicle, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Bokaro in connection with Pindrajora Police Station Case
No.59 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
