1. None appears for the petitioner on call.
2. Learned counsel for the opposite party submits that the transfer application in the present case relates to Misc. Case no. 49 of 2019 under
Order 9 Rule 13 of the Civil Procedure Code, wherein the Matrimonial Suit has been decreed ex parte and the petitioner has prayed for setting aside of the said decree by way of filing the misc. case.
3. It is further submitted by the learned counsel for the opposite party that the misc. case is at the stage of evidence.
4. Considering the conduct of the petitioner herein who has not appeared today and the nature of

relief prayed for, the civil revision is
disposed of with the direction that the trial Court shall proceed expeditiously with the misc. case and dispose of the same preferably within two moths from the date of this order.
5. The prayer for transfer stands rejected.
6. CO 2308 of 2025 stands disposed of.
7. Urgent Photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings.
