The Court: Appeal is directed against judgment and decree dated August 6, 2026. Although Court fees as that of an appeal from a decree was paid by the appellant, learned Senior Advocate appearing for the appellant submits that, inadvertently the appeal was filed as an appeal from order. He submits that, the appeal from order be directed to be treated as an appeal from decree. Respondents are represented.
2 Since, the appeal is directed against a decree, the Department will treat the present appeal as an appeal from decree. Department will number the appeal as an appeal from decree. On doing so, the Department will treat APOT/158/2026 as disposed of. Appellant will prepare informal paper book incorporating all papers used before the learned Trial Judge within two weeks from date. List the appeal from decree three weeks hence.
