1) Matter is heard in presence of learned advocates representing petitioners, State respondents and respondent nos. 4 to 6. 2) From submissions made on behalf of respective parties, it appears that previously in connection with a suit for partition property in question was partitioned by metes and bounds. Subsequently allegation was made by petitioners that there was encroachment of respondent nos. 4 to 6 upon share of property of petitioners. Petitioner has also filed Title Suit No. 234 of 2025 before the learned Civil Judge (Junior Division), 2nd Court, Hooghly and same is pending. 3) Learned advocate representing State respondents has filed a communication dated 8th September, 2026 of Officer-in-Charge, Polba Police Station, Hooghly
2 along with relevant documents and same is taken on record. 4) It is disclosed in communication dated 8th September, 2026 that based on complaint of petitioners two criminal prosecutions were initiated, one being Polba Police Station Case No. 127/2025 dated 13th April, 2025 and another being Polba Police Station Case No. 367/2025 dated 13th December,
2025. Both criminal prosecutions culminated into filing of charge-sheets dated 30th April, 2025 and 31st December, 2025. 5) In view of filing of charge-sheets on completion of investigations in aforesaid two criminal prosecutions, no further order need be passed on this writ petition. 6) Writ petition stands disposed of. 7) However, concerned police authorities are directed to maintain peace and tranquility at the locale and see that no untoward incident takes place. 8) All parties shall act on server copy of this order duly downloaded from official website of this Court.
