Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 3 years and till date the trial has not substantially progressed for a period of one year. No witness has appeared or attended before the Court. As such petitioner be released on bail on any stringent condition.
Learned advocate for the State has produced the case diary, emphasized on the fact that the victim before death when she was a victim of rape, a statement was recorded when she divulged the name and role of each of the accused persons.

So far as the present petitioner is concerned, his name is also appearing therein. After being admitted at hospital on being ravished and injured she expired after two days.
Having considered the ghastly manner in which the offence has been committed and materials do support the claim of the prosecution, at this stage, I am not inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner in CRM (M) 1062 of 2026 is dismissed.
Learned Trial Court is directed to expedite the trial, at least complete all the witnesses who are not associated with the Government Department within a period of one year.
Petitioner will renew his prayer for bail after the aforesaid time period is over.
Memo of Evidence submitted be kept with the record.
