Learned advocate appearing for the petitioner submits that petitioner has been projected to be a witness in the case as is reflected in the report under Section 173 of BNSS and also has been mentioned as accused no. 5.
State has produced the case diary, drawn the attention of the Court to the statement of the minor victim.
I have taken into account the complicity of the present petitioner, assessed regarding the materials appearing and the changed circumstances including principal accused have been taken into custody in connection with the instant case.

As charge sheet has already been submitted and there are no antecedents of the present petitioner, I am inclined to grant the relief of anticipatory bail to the present petitioner.
In view of the aforesaid, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner, namely, Soma Chaki be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge sheet has been submitted before the jurisdictional Court, this order of anticipatory bail will remain in force for a period of 6 weeks from date. Accordingly, CRM (A) 2556 of 2026 is allowed. Memo of Evidence submitted be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
