JUSTICE YARENJUNGLA LONGKUMER O R D E R 30.03.2026 The instant application under Order I Rule 3 R/W Rule 10(2) and Page No.# 4/5 Section 151 of the CPC has been filed by the State respondents praying for impleadment of the Merangkong Village Council, Merangkong Village, Mokokchung as respondent no. 11 in the instant petition. 2. Heard learned Additional AG, Mr. L.T. Sangtam for the applicant as well as Mr. Moa Jamir, learned counsel appearing for the petitioner/respondent and Mr. Pangom W. Kheman, learned counsel appearing for the respondent no. 10. 3. The applicant in the instant application submits that when WP(C)/321/2023 came up on 20.11.2025, this Court had allowed the learned Additional AG, Nagaland to file an application for impleadment of the Merangkong Village Council. The learned Additional AG submits that the land of the petitioner is within the Village area of Merangkong Village. Further, the Merangkong Village Council has made an undertaking to the State respondents that no compensation would be claimed by any villager and moreover, the petitioner being from the Merangkong Village had also supported the undertaking given by the Merangkong Village Council. And that the petitioner could not turn around and take the stand that compensation should be paid in terms of the Land Acquisition Act of 1894. Therefore, the learned Additional AG submits that the Merangkong Village Council needs to be impleaded as a necessary party in the connected WP(C)/321/2023 and WP(C)/236/2023. Accordingly, the prayer in this application is for impleadment of the Merangkong Village Council as respondent no. 11 in WP(C)/321/2023 and as respondent no. 10 in WP(C)/236/2023. Page No.# 5/5 4. This Court has considered the prayer made in the instant application and has perused the pleadings. 5. It is seen that the Merangkong Village Council needs to be impleaded as a necessary party in order to adjudicate the issues in WP(C/236/2023 and WP(C)/321/2023. Accordingly, the instant application is allowed. The applicant/ State respondent shall file the amended Cause Title within a week and thereafter, the petitioner shall take steps for service on the newly impleaded respondent no. 11 in WP(C/321/2023 and respondent no. 10 in WP(C)/236/2023. 6.
