1. Affidavit-of-service, filed by the petitioner, in Court today is taken on record.
2. The petitioner by a Gift Deed dated September 20, 2023, gifted a plot of land measuring about 2.50 decimals situated at Nomunia South, Mouza – Kapasia, Plot No. 4630, Khatian No. 7818, J.L. No. 172, G.P. – Kapasia, District –Uttar Dinajpur, Pin No. – 733128 to the Government.
3. Prior to execution of such Gift Deed, the Child Development Project Officer, Itahar ICDS, Uttar Dinajpur informed the Additional District Sub-Registrar, Itahar, Uttar Dinajpur that the stamp fee had been exempted for the purpose of registration of the said land for AWC construction.
4. Since nothing fruitful happened and no Anganwadi Centre was set up by the respondents despite lapse of a considerable span of time, the petitioner made a representation dated February 5, 2024 to the respondents.
5. The petitioner, by filing this writ petition, has alleged inaction on the part of the respondents in not considering his representation dated February 5, 2024.
6. Although, this Court is not satisfied with the issue that any legal right of the petitioner has been violated, however, the respondent no. 3 is directed to consider his representation dated February 5, 2024 strictly in accordance with law within a period of six weeks from the date of communication of this order after extending an opportunity of hearing to the petitioner and any other interested persons.
7. The respondent no. 3 is further directed to communicate the outcome of the hearing to the petitioner and other interested persons.
8. Accordingly, the writ petition stands disposed of.
9. There shall be no order as to costs.
10. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Arjun Ray Mukherjee, J.) 2
