The present writ petition has been filed praying for a writ of mandamus commanding the respondents to adjust the petitioner on any of the following vacant posts: - “1. M.B. Government P.G. College, Haldwani. 2. Government P.G. College, Halduchaur. 3. Government P.G. College, Kapkot. 4. Government P.G. College, Kashipur.” 2. The petitioner is working as an Assistant Professor (Home Science) at Government P.G. College, Joshimath, Chamoli since her initial appointment as Assistant Professor. 3. Joshimath, Chamoli is a durgam posting. The petitioner has already completed three years at Chamoli. She has filed representations seeking transfer to a sugam place. However, since previous year was declared as “zero session”, therefore, transfers were not effected and, for 1 2026:UHC:1426-DB which reason, the petitioner remained at Chamoli. 4. In the aforesaid backdrop, the present writ petition has been filed seeking direction for posting of the petitioner at any of the sugam places. 5. Learned State Counsel submits that the prayer of the petitioner for transfer to a sugam place would be considered in the coming transfer season, which is to start from May, 2026. He further submits that the previous year was declared as “zero session”, as at the time transfers were to be effected, the Model Code of Conduct was in force in the State in view of the Panchayat elections and by the time the same was withdrawn, the transfer season was over. 6. Having regard to the stand taken by learned State Counsel, we dispose of the instant writ petition by directing the respondents to consider the case of the petitioner for transfer to a sugam place in the ensuing transfer season strictly as per the Transfer Policy. 7.
