Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The office of the Upa Pradhan, Ghoramara Gram Panchayat fell vacant upon acceptance of resignation of the erstwhile Upa Pradhan by the Prescribed Authority on 25h May, 2026. The Prescribed Authority by a notice issued on 5th June, 2026, fixed the date of meeting for election of the new Upa Pradhan on 15th June, 2026. The meeting was postponed/cancelled by a subsequent notice issued on 15th June, 2026. The petitioner, being a member of the Panchayat, seeks a direction upon the Prescribed Authority to convene the meeting and conclude the proceeding in accordance with law. Since the office of the Upa Pradhan is still lying vacant, the Prescribed Authroity and Block Development Officer, Domkar Development Block, being the 6th respondent herein, is directed to convene the meeting for election of the new Upa Pradhan within ten days from the date of communication of this order upon notice to all concerned and take the proceeding to its logical conclusion
2 at the earliest, in accordance with law in terms of rule 6(1) of the West Bengal (Constitution) Rules, 1975, including concurrence of the District Panchayat Election Officer. The Officer in charge, Domkal Police Station, being the 9th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully without any disturbance from any corner whatsoever. The said authority shall ensure safe passage of the members of the Panchayat to the venue of the meeting so that they are able to cast their votes safely and independently. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
