APP Ms. Rima Banerjee … for the State-respondent(s) The petitioner in this case was arrested on November, 2025 and since then he is in custody. The seizure was effected from Aniul Islam and Jamiul Haque. It has been claimed that the persons from whom the seizure has been effected have been released on bail. So far as the present petitioner is concerned, there has been no recovery from the present petitioner. Having considered the locus of the present petitioner I am of the view that the petitioner is better placed than the other accused persons who are on bail, as such, I am inclined to grant bail to the present petitioner. 2 Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Hasmat Miya @ Hasmat Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act), 3rd Court, Malda. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Malda without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 415 of 2026 is allowed. Pending application(s), if any, is also disposed of.
