Learned Advocate appearing for the petitioners submits that petitioner no. 1 is the brother-in-law, petitioner no. 2 is the mother-in-law, petitioner no. 3 is the brother-in-law, petitioner no. 4 is the brother-in-law, petitioner no. 5 & 6 are the sisters-in-laws of the deceased. 2. It has been contended on behalf of the petitioners that the wife/ daughter-in-law committed suicide pursuant to

which the petitioners and other family members were foisted with the criminal case of dowry death. 3. State has opposed the prayer for bail and drawn the attention of the Court to the post-mortem report as well as the statement of the witnesses. 4. I have taken into account the materials appearing in the Case Diary as also the case records from where it reflects that the husband and the father-in-law of the deceased were arrested and subsequently granted bail. 5. Having considered that charge-sheet has already been submitted and no physical injuries are reflecting from the medical documents which are present in the Case Diary. Custodial detention of the present petitioners may not be warranted in the facts of the case. As such prayer for anticipatory bail of the present petitioners is allowed. 6. As such, I direct that in the event of arrest, the petitioners, namely, 1. Samirul Shah @ Samiruddin Shah 2. Sabira Bibi 3. Safidul Shah @ Sabidul Sha @ Dantu 4. Amirul Shah @ Musibar 5. Putul @ Asmina Khatun 6.
Fate Bibi @ Jahanara be released on bail by the Investigating Officer/arresting officer of the case on such terms and conditions as it deems fit and proper. This would be subject to the conditions under Section 438(2) of the Cr.P.C and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 3
7. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks. 8. Accordingly, CRM (A) 2963 of 2026 is allowed. 9. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court. 10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
