It is well settled that the matters to be considered in an application for bail are (i) whether there is any prima facie or reasonable ground to believe that the accused had committed the offence; (ii) nature and gravity of the charge; (iii) severity of the punishment in the event of conviction; (iv) danger of accused absconding or fleeing if released on bail; (v) character, behaviour, means, position and standing of the accused; (vi) likelihood of the offence being repeated; (vii) reasonable apprehension of the witnesses being tampered with; and (viii) danger, of course, of justice being thwarted by grant of bail (see Prahlad Singh Bhati vs. NCT, Delhi 2001 (4) SCC 280 and Gurcharan Singh vs. State (Delhi Administration) AIR 1978 SC 179). While a vague allegation that accused may tamper with the evidence or witnesses may not be a ground to refuse bail, if the accused is of such character that his mere presence at large would intimidate the witnesses or if there is material to show that he will use his liberty to subvert justice or tamper with the evidence, then bail will be refused. Any order devoid of such reasons would suffer from non- application of mind. It is also necessary for the court granting bail to consider among other circumstances, the following factors also before granting bail; they are: a. "17.7. Therefore, as mentioned supra, Section 167(2) is integrally linked to the constitutional commitment under Article 21 promising protection of and personal liberty against unlawful and arbitrary detention, and must be interpreted in a manner

State of Assam, which laid down certain seminal principles as to the interpretation of Section 167(2) CrPC though the questions of law involved were somewhat different from the present case. The questions before the three-Judge Bench in Rakesh Kumar Paul were whether, firstly, the 90-day remand extension under Section 167(2)(a)(i) would applicable in respect of offences where the maximum period of imprisonment was 10 years, though the minimum period was less than 10 years. Secondly, whether the application for bail filed by the accused could be construed as an application for default ball, even though the expiry of the statutory period under Section 167(2) had not been specifically pleaded as a ground for bail. The majority opinion held that the 90-day limit is only available in respect of offences where a minimum ten year' imprisonment period is stipulated, and that the oral arguments for default bail made by the counsel for the accused before the High Court would suffice in lieu of a written application. This was based on the reasoning that the court should not be too technical in matters of personal liberty. Madan B. The benefit of proviso appended to sub-section (2) of Section 167 of the Code would be available to the offender only when a charge-sheet is not filed and the investigation is kept pending against him. Once however, a charge-sheet is filed, the said right ceases. It may be noted that the right of the investigating officer to pray for further investigation in terms of sub-section (8) of Section 173 is not taken away only because a charge-sheet is filed under sub-section (2) thereof against the accused. Though ordinarily all documents relied upon by the prosecution should accompany the charge-sheet, nonetheless for some reasons, if all the documents are not filed along with the charge-sheet, that reason by itself would not invalidate or vitiate the charge-sheet. It is also well settled that the court takes cognizance of the offence and not the offender. Once from the material produced along with the charge-sheet, the court is satisfied about the commission of an offence and takes cognizance of the offence allegedly committed by the accused, it is immaterial whether the further investigation in terms of Section 173(8) is pending or not. "22. It is true that ordinarily all documents accompany the charge-sheet.
But, in this case, some documents could not be filed which were not in the possession of CBI and the same were with GEQD. As indicated hereinbefore, the said documents are said to have been filed on 20-1-2006 whereas the appellant was arrested on 12-2-2006. The appellant does not contend that he has been prejudiced by not filing of such documents with the charge-sheet. No such plea in fact had been taken. Even if all the documents had not been filed, by reason thereof submission of charge-sheet itself does not become vitiated in law. The charge- sheet has been acted upon as an order of cognizance had been passed on the basis thereof. The appellant has not questioned the said order taking cognizance of the offence. Validity of the said charge-sheet is also not in question. ***
39. The statutory scheme does not lead to a conclusion in regard to an investigation leading to filing of final form under sub-section (2) of Section 173 and further investigation contemplated under sub-section (8) thereof. Whereas only when a charge-sheet is not filed and investigation is kept pending, benefit of proviso appended to sub-section (2) of Section 167 of the Code would be available to an offender; once, however, a charge-sheet is filed, the said right ceases. Such a right does not revive only because a further investigation remains pending within the meaning of sub-section (8) of Section 173 of the Code."

"8.3 The Hon'ble Supreme Court has, in a catena of judgments, held that once a final report under Section 193 of the BNSS (corresponding Section 173(2) of the CrPC) is filed within the prescribed period, the accused cannot claim statutory default bail on the ground that further investigation under Section 193 of the BNSS (corresponding Section 173(8) of the CrPC) is pending or that certain supplementary documents are yet to be filed.
In this regard, the Hon'ble Supreme Court in Central Bureau of Investigation v. Kapil Wadhawan2, has held in unequivocal terms that:
“23. The benefit of proviso appended to sub-section (2) of Section 167 of the Code would be available to the offender only when a charge-sheet is not filed and the investigation is kept pending against him. Once however, a charge-sheet is filed, the said right ceases. The pendency of the further investigation qua the other accused or for production of some documents not available at the time of filing of charge-sheet would neither vitiate the charge-sheet, nor would it entitle the accused to claim right to get default bail on the ground that the charge-sheet was an incomplete charge-sheet or that the chargesheet was not filed in terms of Section 173(2) CrPC.” *** 8.5 Therefore, it is made out that the right to default bail arises only where no final report as contemplated under Section 193 of the BNSS (corresponding Section 173(2) of the CrPC) is filed within the stipulated period. However, once a report, complete in material particulars and disclosing commission of a cognizable offence, is filed before the Magistrate, the right to default bail is not available to the accused. What constitutes a complete charge sheet is not dependent upon the subjective satisfaction of the accused but on whether the Magistrate is in a position to take cognizance of the offences disclosed from the material placed on record.
The same is also in line with the observations made by the Hon'ble Supreme Court in Dablu Kujur v. State of Jharkhand4. In the said judgment, the following was observed:
“14. It may be noted that though there are various reports required to be submitted by the police in charge of the police station before, during and after the investigation as contemplated in Chapter XII CrPC, it is only the report forwarded by the police officer to the Magistrate under sub- section (2) of Section 173 CrPC that can form the basis for the competent court for taking cognizance thereupon. A chargesheet is nothing but a final report of the police officer under Section

16. The issues with regard to the compliance of Section 173(2) CrPC, may also arise, when the investigating officer submits police report only qua some of the persons-accused named in the FIR, keeping open the investigation qua the other persons- accused, or when all the documents as required under Section 173(5) are not submitted. In such a situation, the question that is often posed before the court is whether such a police report could be said to have been submitted in compliance with sub- section (2) of Section 173 CrPC. 17. In this regard, it may be noted that in Satya Narain Musadi v. State of Bihar [Satya Narain Musadi v. State of Bihar, (1980) 3 SCC 152 : 1980 SCC (Cri) 660], this Court has observed that statutory requirement of the report under Section 173(2) would be complied with if various details prescribed therein are included in the report.
The report is complete if it is accompanied with all the documents and statements of witnesses as required by Section 175(5). In Dinesh Dalmia v. CBI [Dinesh Dalmia v. CBI, (2007) 8 SCC 770 : (2008) 1 SCC (Cri) 36], however, it has been held that even if all the documents are not filed, by reason thereof the submission of the charge-sheet itself would not be vitiated in law. 18. Such issues often arise when the accused would make his claim for default bail under Section 167(2) CrPC and contend that all the documents having not been submitted as required under Section 173(5), or the investigation qua some of the

13. In a recent judgment in the case of Central Bureau of Investigation v. Kapil Wadhawan, 2024 SCC OnLine SC 66, the Supreme Court observed that there cannot be any disagreement with the well-settled legal proposition that right to default bail under Section 167(2) Cr. P.C. is not only a statutory right but a right that flows from Article 21 of the Constitution of India. It is an indefeasible right, nonetheless it is enforceable only prior to filing of the challan or the Charge Sheet, after which the question of grant of bail has to be considered and decided only with reference to merits of the case, under the provisions relating to grant of bail to an accused, post the filing of the Charge Sheet. The bone of contention between the rival parties before the Supreme Court was whether the Charge Sheet filed by the CBI during ongoing investigation qua other Respondents could be treated as a complete Charge Sheet. Referring to the
judgment of the Constitution Bench of the Supreme Court in K. Veeraswami v. Union of India, (1991) 3 SCC 655, the Supreme Court held that the statutory requirement of the report under Section 173(2) Cr. P.C. would be complied with if the various details prescribed therein are included in the report. The report under Section 173 Cr. P.C., is an intimation to the Court that upon investigation into the cognizable offence, Investigating Officer has been able to procure sufficient evidence for the Court to inquire into the offence and necessary information is being sent to the Court. It is not necessary that all details of the offence

Though ordinarily all documents relied upon by the prosecution should accompany the Charge Sheet, nonetheless, if for some reasons, all documents are not filed, that reason by itself would not invalidate or vitiate the Charge Sheet, as the Court takes cognizance of the offence and not the offender. Once, from the material produced along with Charge Sheet, Court is satisfied about the commission of an offence and takes cognizance of the offence allegedly committed by the accused, it is immaterial whether further investigation in terms of Section 173(8) Cr. P.C. is pending or not. Pendency of further investigation for production of some documents not available at the time of filing of the Charge Sheet would neither vitiate the Charge Sheet nor entitle the accused to seek default bail on that ground, as a matter of right. The pendency of the further investigation qua the other accused or for production of some documents not available at the time of filing of chargesheet would neither vitiate the chargesheet, nor would it entitle the accused to claim right to get default bail on the ground that the chargesheet was an incomplete chargesheet or that the chargesheet was not filed in terms of Section 173(2) of Cr. 28. Thus, it has been held by this Court in plethora of decisions that non-filing of FSL report along with the charge sheet does not fall within the ambit of Section 173(2) of CrPC so as to consider it as “incomplete charge sheet” and, accordingly, no right of default bail is accrued in favour of the accused. XXX XXX XXX
32. Mere non-filing of the FSL Report along with the charge sheet is not sufficient to arrive at the conclusion that the charge sheet filed was incomplete. The said report can be filed by way of a supplementary charge sheet. In any case, The FSL report, if any, would only be a corroborative piece of evidence.
And, even after filing of the charge sheet, further investigation can continue under Section 173(8) of the CrPC.”

"113. The legal position pertaining to scope of section 167(2) of the Code emanating from above referred decisions can be summarised as under:—
[2026:RJ-JP:8616] (49 of 78) [CRLMB-16987/2025] i) The object of the section 167(2) of the Code is to ensure an expeditious investigation and a fair trial and is another limb of Article 21. ii) The accused has indefeasible right in his favour for being released on bail on account of default by the investigating agency to complete investigation within the prescribed period. iii) It is duty of the courts to ensure that benefit of Section 167(2) of the Code be given to the accused and detention beyond statutory period would be illegal being opposed to the liberty of the accused. iv) Section 173 of the Code does not stipulate a piece-meal investigation and filing of incomplete charge sheet before Court and contemplates filing of a final report after completion of the entire investigation of the case in respect of all offences and where several offences are involved in a case. The practice of filing preliminary charge sheets to seek extension of remand beyond the statutory period should be deprecated. v) The charge report can be filed before the court only after the investigation is over and formation of an opinion regarding all the offences alleged against the accused. vi) There is a distinction between completion of investigation and further investigation. The further investigation can be resorted to only after the completion of investigation and filing of charge sheet. vii) The investigating agency cannot circumvent section 167(2) of the Code by filing incomplete charge sheets.
The police report or charge sheet cannot be send within the meaning of Section 173 (2) till the investigation is completed and any report sent before the investigation is completed will not be a police report within the meaning of section 173(2) of the Code. [2026:RJ-JP:8616] (50 of 78) [CRLMB-16987/2025] viii) The incomplete charge sheet filed without completing the investigation cannot be used to defeat the right of statutory bail under Section 167(2) of the Code. ix) The right of the accused to statutory bail came to an end once the charge sheet is filed within the stipulated period. The filing of charge sheet is sufficient compliance with the provisions of Section 167(2) of the Code and taking of cognizance is not material to Section 167. x) There can only be one charge sheet but there is no restriction on filing of number of supplementary charge sheets. xi) The charge-sheet can be said to be complete when it enable the court to take or not to take cognizance of the offence after application of mind and if certain facets called for further investigation does not render such report anything other than a final report. xii) The power of Magistrate to take cognizance is not lost even if the police report is termed as incomplete by the investigating officer. xiii) If the charge-sheet is not filed then right for default bail has ripened into status of indefeasibility which cannot be frustrated by the prosecution and the courts on any pretext. xiii) Economic offences having deep rooted conspiracies and involving huge loss of public funds, constitute a class apart and need to be viewed seriously."

"Criminality and corruption go hand in hand. From the date the Constitution was adopted i.e. 26-1-1950, a Red Letter Day in the history of India, the nation stood as a silent witness to corruption at high places. Corruption erodes the fundamental tenets of the rule of law. In Niranjan Hemchandra Sashittal v. 8. Indubitably, the allegations raised in the FIR in question are serious in nature which are not confined only to monetary gain alone. According to the prosecution, the petitioner, who is a practising Advocate demanded large amount of money by claiming that he could influence a judicial officer and secure a favourable order in a divorce case. Such allegations, if found true, do not affect only the complainant but have a wider impact on public trust in the justice delivery system. The material which has been placed on record before this Court shows that the complaint was first verified by the CBI before the FIR in question was registered.
The recorded conversations, the verification report, and the trap proceedings prima facie indicate a demand for illegal gratification and the collection of part of the bribe amount through a co-accused. At this stage, this material cannot be legally ignored or brushed aside. The argument that the petitioner is not a public servant does not help him at this stage as Section 7-A of the Prevention of Corruption Act squarely covers any person who accepts or obtains undue advantage to influence a public servant by corrupt or illegal means. The age and professional standing of the petitioner, though relevant, cannot outweigh the gravity of the allegations. Upon directions issued by this Court, the medical condition of the petitioner was got assessed by the CBI and nothing has come forth which may entitle the petitioner to be afforded regular bail on medical ground(s). Furthermore, whether the judicial officer named in the complaint was actually competent to pass the order is matter of defence and will be examined during the course of trial. The Hon'ble Supreme Court has consistently held that offences involving corruption, particularly those undermining

In cases involving corruption and misuse of influence in the judicial process, such factors by themselves are not sufficient to grant bail especially when the allegations are supported by prima facie material. The petitioner is an Advocate with long professional experience. At this stage, it cannot be said that there does not exist a reasonable apprehension/concern that his release may affect the course of investigation or trial including the possibility of influencing the witness(s). The rejection of bail by the learned Special Judge, CBI, Chandigarh, after consideration of the material on record, further persuades this Court not to take a contrary view in the absence of any substantial change in circumstances. 8.1.
Much emphasis has been laid by the learned Senior Advocate on the fact of investigation having been culminated in the filing of Challan/Final Report and the petitioner having suffered incarceration for more than 5 months for an offence punishable (maximum) up to 7 years of imprisonment. Indubitably, in a case under the Prevention of Corruption Act, the conclusion of the investigation and the subsequent presentation of Challan/Final Report, as well as, the petitioner having undergone a custody of around 5½ months for an offence punishable with up to 7 years of Imprisonment (maximum), constitute factors relevant for consideration of bail, however, they cannot be viewed in vacuum and nor do they operate as an absolute passport for enlargement on bail. Indubitably, in a case under the Prevention of Corruption Act, the conclusion of the investigation and the subsequent presentation of Challan/Final Report, as well as, the petitioner having undergone a custody of around 5½ months for an offence punishable with up to 7 years of Imprisonment (maximum),

When an advocate, who is considered as an officer of the Court, solicits or accepts illegal gratification under the pretext of influencing a judicial outcome, the act is not merely a private fraud but sacrilegious affront to the judiciary as an institution. It is the duty of this Court to treat such transgressions as an existential threat to the sanctity of the institution.

Succinctly, the case of the petitioner is that in the Court below the petitioner alongwith six others have been made accused of the charges under Sections 120B, 420, 467, 468, 471, 409 of the Penal Code, 1860 read with Sections 13(2) and 13(1) (d) of the Prevention of Corruption Act, 1988 for their involvement in criminal conspiracy, by abusing their position as

Said complaint was lodged by one Subrata Chakraborty Inspector of Police - CBI/ASB/Calcutta on 19th January, 1998 to the effect that the accused persons made reckless advances to some private firms to the tune of Rs.
3,36,11,000 approximately in the form of clean overdraft beyond sanction limit unauthorisedly and irregularly in relation to the bank norms and procedure and thereby committed the offence of cheating against Allahabad Bank. Present petitioner was the then Chief Manager of Allahabad Bank Red Cross Place, Calcutta and he allowed undue favour to M/s Calcutta Veneer Industries Pvt. Ltd. by allowing clean overdraft on different dates from December 1992 to April 1993. He had also wilfully overlooked unlawful sanction of financial benefit allowing excess bank guarantee limit to M/s Jain Associates. With similar series of allegations the petitioner was made accused in that case for allowing cash-drawing in favour of M/s. Calcutta Extrusion Pvt. Ltd. unauthorisedly and irregularly. Central Bureau of Investigation as the Investigating Agency submitted three separate charge-sheets in that case after completion of investigation against the accused persons. Cognizance was taken of the offences on all the three charge- sheets on 20.12.2001 by learned Chief Judge, City Sessions Court, Calcutta and the cases were transferred to the file of learned Special Judge, 3rd Court at Calcutta and upon receipt of records of the case, learned Special Judge, 3rd Court, Calcutta issued process in the name of the petitioner on 05.02.2002. The petitioner made a prayer before the learned Special Judge for his discharge on the ground of deliberate delay caused by the prosecution stating inter alia that an amicable settlement has been attained by the Allahabad Bank with the petitioner. The petitioner challenged the maintainability of the case on the ground that three charge-sheets were illegally submitted against
[2026:RJ-JP:8616] (66 of 78) [CRLMB-16987/2025] one First Information Report. Petitioner has cited a decision dated 24.9.2012 of the Hon'ble Apex Court in Gian Singh v. The State of Punjab stating in paragraph 7 of this application the observations made by the Hon'ble Apex Court. Learned Special Judge, 3rd Court has rejected the prayer of the petitioner for discharge and, therefore, the instant case has been filed by the petitioner. I have gone through the application of the petitioner and certified copy of the impugned order dated 28.02.2014 passed by learned Judge, 3rd Special Court, Calcutta in Special Case No. 5 of 2001.
In the impugned order rejecting the prayer of the petitioner learned Judge, Special Court has observed that mere repayment of loan under settlement cannot exempt accused from criminal proceedings when the criminal conspiracy was alleged and prima facie offence against the accused has been made out by filing specific charge-sheet after prolonged investigation by the C.B.I. On going through the impugned order I do not find anything against legality, propriety and correctness of the impugned order. In my view, said order does not cause miscarriage of justice. In paragraph 7 of the application the petitioner has referred to some observations of the Hon'ble Apex Court in Gian Singh's case. On going through the same it appears from observation of the Hon'ble Apex Court that any compromise between the victim and offender in relation to the offences under special statutes like Prevention of Corruption Act of the offences committed by public servant while working in that position etc. - cannot provide for any basis for quashing the criminal proceedings involving such offences. This observation clearly goes against the petitioner in the instant case. This Court is satisfied to follow the Latin maxim, ‘factum infectum fieri nequit’ (thing done cannot be undone). The alleged offence is grave in nature against the society relating to finance involving public at large. Excepting the charge under Section 420 of the
[2026:RJ-JP:8616] (67 of 78) [CRLMB-16987/2025] Penal Code, 1860 all other charges brought against petitioner are non-compoundable. Provision under Section 482 of the Code of Criminal Procedure provides for exercising such power to prevent abuse of process of any Court or otherwise to secure the ends of justice. Said section provides for giving effect to any
order under the Code of Criminal Procedure and not for violating the provisions of the Code including Section 320 of that Code which stands on the way of compounding the offences punishable under Sections 467/468/471/409/120B of the Prevention of Corruption Act, 1988. Filing of multiple charge- sheets on single FIR is not barred when circumstances prevail, like the instant case, so demand. Learned Judge in the trial Court has very rightly followed the decision is of this High Court in the case of Ramkrishna Goswami v. The State of West Bengal reported in (2014) 1 C.Cr.LR. (Cal) 357 which has also been cited by learned Advocate for the opposite party at the time of hearing this case. It is true that there is inordinate delay in disposal of the case in the trial Court but that alone cannot be a ground for quashing the proceedings of the trial Court. It appears from the impugned order that in the trial Court the case is in the stage of trial as the case was fixed on 5.5.2014 for recording prosecution evidence. A direction may be given to the trial Court for concluding the trial within six months from the date of communication of copy of this judgment."
