Call for the entire records in C.C.No.7310/2024 (FIR No.0231/2024) pending on the file of the Addl. Civil Judge & JMFC Court, Magadi, Ramanagara Dist. b. Quash the FIR dated 30.7.2024, culminating in the Charge Sheet dated 05.11.2024 and the entire proceedings pending against the petitioner/Accused No.8 in C.C.7310/2024 (Cr.No.231/24) pending before the Court of the Addl. Civil Judge & JMFC Court, Magadi, Ramanagara Dist for the offences punishable under Section BNS 2023 U/s 189(2), 329(3), 126(2), 324(4), 74, 115(2), 118(1), 352, 351(2), 190 of BNS. c. The submission of Sri.N.K.Ramesh, learned counsel for the petitioner is that in the complaint lodged by respondent No.2 on 30.07.2024, on which basis, Crime No. 231/2024 has been registered by Kudur Police Station, Magadi, does not reflect any overt act on the part of the petitioner. He submits that overt acts have been attributed to various other accused, only the name of the petitioner has been found in the last but one line of the complaint. On that basis, he submits that no overt act has been attributed to the petitioner. The continuation of the criminal proceedings against the petitioner is unwarranted and would cause injustice and untold harm and injury to the petitioner. 3. Learned HCGP by referring to the statements of CW2, CW5 and CW6, submits that the witnesses have specifically averred as regard to the overt act of the petitioner. They have given a statement of having witnessed the overt act on part of the - 4 - HC-KAR CNR: KAHC010703252025 NC: 2026:KHC:49433 CRL.P No. 14884 of 2025 petitioner including pulling the sweater of the complainant and pushing her down to the floor, as also assaulting complainant. 4. Heard Sri.N.K.Ramesh, learned counsel for the petitioner and learned HCGP. Perused papers. 5. At this stage, it cannot be said that the petitioner is not involved in the incident, more so when a charge sheet has been laid on the basis of the witness’ statements imputing overt acts on the part of the petitioner. In that view of the matter, the above petition is dismissed with liberty to raise all defenses before the trial Court during the course of trial.
