It appears that the learned Chief Judicial Magistrate, Howrah, issued warrants of arrest against the petitioners on account of their failure to appear before him in connection with G.R. Case No. 5091 of 2020 under Sections 341/186/353/332/333/326/506/34 of the Indian Penal Code, 1860. It further appears that, on the subsequent dates fixed for hearing, the petitioners also failed to appear before the learned Magistrate. Mr. Kali, learned advocate appearing for the petitioners, submits that, owing to a communication gap between the petitioners and their learned advocate, the petitioners could not appear before the learned Magistrate. He, however, submits that the petitioners are willing and prepared to surrender before the learned Magistrate within a period of three weeks from date. 2 In view of the aforesaid circumstances, the warrants of arrest issued against the petitioners are stayed for a period of three weeks from the date of this order, subject to the condition that the petitioners shall surrender before the learned Magistrate within the said period. In the event that the petitioners surrender before the learned Magistrate within the stipulated period, any application for bail that may be filed by them shall be considered and decided in accordance with law, without being influenced by the observations made in this order. In the event that the petitioners fail to surrender within the stipulated period in terms of this order, the warrants of arrest shall stand revived automatically, and the learned Magistrate shall be at liberty to execute the same in accordance with law. Accordingly, CRR 3719 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
