GUNDAPU RAJESH KUMAR The Court made the following: 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.4573 of 2023 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate Writ, order or direction more particularly, one in the nature of Writ of Mandamus, declaring the action of the Executive officer of 4th respondent temple in allowing the 5th and 6th respondents to offer naivedyam in the 4th respondent temple as bad, illegal, arbitrary, without jurisdiction and violative of Articles 14, 21, 25 & 300-A of Constitution of India and consequently direct the respondents 4 to 6 not to interfere with the Petitioners right to offer Maha Naivedyam in 4th respondent temple and pass such other order or orders.…” 2. The present writ petition is filed to challenging the action of the 4th respondent-Executive Officer in permitting the 5th and 6th respondents to offer Naivedyam in the 4th respondent temple. Consequently, the petitioner prays to direct the respondents not to interfere with the petitioner’s right to offer Maha Naivedyam in the 4th respondent temple. 3. Heard Sri D.V.Sasidhar, learned counsel for the petitioner; learned Government Pleader for Endowments appearing for respondent Nos.1 to 3; Ms.Pulipati Radhika, learned Standing Counsel appearing on behalf of respondent No.4 and Sri G.Rajesh Kumar, learned counsel for respondent Nos.5 and 6. 4. Learned counsel for the petitioner as well as the learned counsel appearing for respondents submitted that the petitioner herein had earlier filed 4 W.P.No.22287 of 2020. A Co-ordinate Bench of this Court has disposed the said writ petition vide order dated 21.03.2025, suggesting or advising the petitioner to approach the Endowments Tribunal to challenge the order impugned in the writ petition, while protecting the interest of the petitioner from the time of filing interlocutory application until the disposal of the original application (O.A.) by the Endowments Tribunal. 5. Whereas, the relief sought in the previous writ petition i.e., in W.P.No.22287 of 2020 was to conduct Archakatvam. The relief sought in the present writ petition is to offer Naivedyam in the same temple. 6. Under these circumstances, the present Writ Petition is disposed of granting liberty to the petitioner to approach the Endowments Tribunal to seek the relief of offering Naivedyam to the deity. There shall be no order as to costs.
