ORAL ORDER
Heard the learned counsel appearing for the petitioners and the learned High Court Government Pleader for respondent No.1-State.
2. This petition is filed to quash the proceedings in C.C. No.27286/2025 pending before XXIV Additional Chief Judicial Magistrate, Bengaluru. The offences alleged are under Sections 85, 115(2), 351(2), 352 of the Bharatiya Nyaya Sanhita, 2023, ('BNS') read with Section 3(5) of the Dowry Prohibition Act, 1961 ('Act, 1961').

Learned counsel appearing for the petitioners would submit that petitioner No.1 is the husband and petitioner No.2

is the mother of petitioner No.1 and mother-in-law of the respondent No.2.
4. It is submitted that the complaint is filed making bald allegations and the complainant has no intention to lead a marital life with the petitioner No.1 and she is demanding Rs.30,00,000/- as alimony. Merely because the alimony demand is not met, the complaint is filed making false allegations against the petitioners as well as the sister-in-law.

Learned counsel appearing for the petitioners would submit that the charge sheet is not filed against the sister-in- law. The charge sheet is filed against the husband and the mother-in-law of the complainant. The learned counsel would also submit that the complaint is filed after the complainant left the house of the petitioners and there are no materials in the charge sheet to substantiate the contentions raised in the allegations made in the complaint.
6. Learned High Court Government Pleader would submit that there are three eyewitnesses to the alleged incident and after investigation, the charge sheet is filed.

Learned counsel for the petitioners would submit that there are no wound certificates in the charge sheet.
8. The Court after going through the contents of the complaint is of the view that prima facie allegations are found to attract the provisions of the Bharatiya Nyaya Sanhita, 2023 as well as Act, 1961.
9. Whether the alleged incident has really taken place or not is a matter of trial. The contentions raised by the petitioners are based on disputed questions of facts. Merely because the wound certificate is not produced, it does not mean that the contents of the complaint are false.
10. Petition is dismissed.
