Ms. Soma Mishra Chatterjee, Mr. Amit Roy ... For the State. Leave is granted to the learned advocate-on-record of the petitioners to amend the cause title. Learned advocate appearing for the petitioners submits that petitioners are similarly placed as other accused persons who have been granted anticipatory bail on 17.07.2026 in CRM(A) 1765 of 2026. It reflects from the said order that complaint related to incident commencing from 05.08.2020 and the present complaint was filed before the police station on 25.05.2026. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail. I have taken into account the locus of the present petitioners which is similar to the other accused persons 2 who have been granted anticipatory bail in CRM(A) 1765 of 2026. Having regard to the same, I am inclined to grant anticipatory bail to the present petitioners. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners viz., 1. Habib Ali @ Bhola and 2. Suraj @ Suraj Ali shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. The application for anticipatory bail, being CRM (A) 2577 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
