JUSTICE E.S.INDIRESH ORAL ORDER 1. In this petition, the petitioners are assailing the order dated 18.10.2019 (Annexure - A) passed by respondent No.2. 2. Heard Sri.Nataraj Baba K, learned counsel appearing for the petitioners, Smt.Sharada H.V, learned Additional Government Advocate for respondent Nos.1 to 3 and Sri.Pradeep Kumar R.H, learned counsel appearing for respondent No.4. 3. It is forthcoming that the proceedings under Sections 79A and 79B of the Karnataka Land Reforms Act, 1961, was initiated against the vendor of the petitioners herein (respondent No.4). 4. A perusal of the impugned order at Annexure - A would indicate that fair opportunity has not been extended to the vendor of the petitioners (respondent No.4). In that view of the matter, as the provisions contained under - 4 - HC-KAR CNR: KAHC010750152024 NC: 2026:KHC:50079 WP No. 36133 of 2024 Sections 79A and 79B of the Karnataka Land Reforms Act, 1961, have been omitted and amended by the respondent - State and therefore, following the declaration of law made by this Court in W.P.No.12829/2023 on 01.04.2025, the writ petition requires to be allowed. In the result, I pass the following; ORDER (i) The writ petition is allowed. (ii) The order dated 18.10.2019 (Annexure - A) passed by respondent No.2 is accordingly set aside. (iii) Respondent No.3 is directed to enter the name of the petitioners in the revenue records in respect of the subject land within two months from the date of receipt of this order.
