JUSTICE ANU SIVARAMAN) We have heard the learned counsel appearing for the appellants as well as learned counsel appearing for the respondents. 2. A memo has today been filed on behalf of respondent Nos.1 and 2 seeking leave of this Court to withdraw the writ petition from which this appeal arises - 4 - HC-KAR CNR: KAHC010848102025 NC: 2026:KHC:49196-DB WA No. 2093 of 2025 i.e., W.P.No.25959/2025. However, we notice that the memo seeks leave of this Court for filing a writ petition after impleading the appellants. We also notice that WP.No.25959/2025 had been filed without disclosing the pendency of W.P.No.261/2022 and the interim order dated 27.03.2025 is passed in that writ petition. The memo reads as under: MEMO The appellants have called in question the order passed in W.P. No.25959/2025 allowing the Writ Petition and also sought leave to question the orders passed by the Writ Petition since they have not impleaded before the learned Single Judge. The Respondent No.1 and 2 submit that they seek leave of this Hon'ble Court to withdraw the Writ Petition bearing No.25959/2025 on the file of the learned Single Judge of this Hon'ble Court and further seek leave to seek redressal in the appropriate manner in accordance with law by filing a writ Petition after impleading the Appellants before this Hon'ble Court. Wherefore, it is prayed that this Hon'ble Court may be pleased to dismiss the Writ Petition bearing - 5 - HC-KAR CNR: KAHC010848102025 NC: 2026:KHC:49196-DB WA No. 2093 of 2025 No.25959/2025 on the file of the learned Single Judge of this Hon'ble Court us withdrawn permitting liberty to file another Writ Petition after impleading the Appellants in accordance with law, in the interest of justice and equity." 3. In the above view of the matter, we are of the opinion that the leave sought to file a further writ petition in the matter cannot be granted. W.P.No.25959/2025 is, accordingly, dismissed as withdrawn. 4. In view of withdrawal of W.P.No.25959/2025, nothing further survives for consideration in this appeal.
