1. Affidavit-of-service filed on behalf of petitioners is taken on record.
2. By presenting this writ petition prayer is made for directing the concerned police authority to take steps which would protect right of petitioners over the shop- room in question.
3. State respondents and respondent nos.5 to 7 are represented by learned advocates.
4. It is submitted on behalf of respondent nos.5 to 7 that petitioners are tenants in respect of a shop-room and respondent nos.5 to 7 are landlords. It is also submitted that petitioners have instituted a Title Suit being no.250/ 2026 before the learned Civil Judge (Junior Division), 2nd Court, Diamond Harbour.
5. During pendency of aforesaid title suit, it will not be apt to direct the concerned police authority to take steps for preserving right of petitioners in connection with said shop-room. If petitioners find that their right in connection with said shop-room is infringed,
[2] in that event, petitioners are required to approach Civil Court.
6. In view of complaint lodged against private respondents alleging threat and intimidation, concerned police authorities are directed to maintain peace and tranquility and to see that no untoward incident takes place.
7. Writ petition stands disposed of.
